Even today, jail is supposed to keep you around to be punished, /prison/ is for punishment, although with overcrowding and the profusion of misdemeanor convictions, even a lawyer can be forgiven for making that mistake.
Hence the rise of penitentiaries. Unfortunately, they’re often run for profit, and that creates a demand for criminals.
