This is EXACTLY what always bugged me about the “and do you see that person in the courtroom today?” Sometimes it’s pretty obvious who the defendant is when he’s the one in casual dress sitting at the table filled with lawyers (or maybe he’s the only male at a table with a female defense team or he’s white and the defense lawyers are black, etc, etc.)

    Can the defense have the suspect sit in the audience or have 3 other people that look kinda like him/her sit at the table briefly and THEN have the witness come in and be asked that question?
