If it&#8217;s to be\u00a0<strong>meaningful,<\/strong> its words must mean what we think they mean\u00a0<strong>here!<\/strong><\/p>\n<p style=\"text-align: center\">Or what they\u00a0<strong>ought<\/strong> to mean?<\/p>\n<p style=\"text-align: center\">What we can\u00a0<strong>make<\/strong> them mean!<\/p>\n<p style=\"text-align: center\">I mean&#8230;<\/p>\n<p style=\"text-align: center\">&#8230;Hey, that&#8217;s mean<\/p>\n<p><em>James Wilson arguing with a modern judge<\/em><\/p>\n<p style=\"text-align: center\"><em>JAMES WILSON<\/em><\/p>\n<p style=\"text-align: center\">You mea- uh, unelected judges&#8230;\u00a0<strong>rewriting<\/strong> the Constitution? Who died and made\u00a0<span style=\"text-decoration: underline\">you<\/span> sovereign?<\/p>\n<p style=\"text-align: center\">If\u00a0you\u00a0<strong>care<\/strong> what we were thinking, this is precisely the kind of power grab we were trying to\u00a0<strong>prevent.<\/strong><\/p>\n<p style=\"text-align: center\"><em>MODERN JUDGE<\/em><\/p>\n<p style=\"text-align: center\">No, you misunderstand!<\/p>\n<p style=\"text-align: center\">We&#8217;re only re-<strong>interpreting<\/strong> the language, so it can apply to new issues. Nobody is re-<strong>writing<\/strong> anything.<\/p>\n<p style=\"text-align: center\"><em>WILSON<\/em><\/p>\n<p style=\"text-align: center\">Then\u00a0<strong>amend<\/strong> the language so it\u00a0<strong>does<\/strong> apply! If our ideas would break society, then\u00a0<strong>fix<\/strong> them with an amendment!<\/p>\n<p style=\"text-align: center\"><em>But!<\/em> It must be the\u00a0<strong>people<\/strong> who fix it, not a handful of well-meaning know-it-alls in government.<\/p>\n<p><em>Sis with an &#8220;aw, do we have to&#8221; posture<\/em><\/p>\n<p style=\"text-align: center\"><em>SIS<\/em><\/p>\n<p style=\"text-align: center\">But amending it is so\u00a0<strong>hard!<\/strong><\/p>\n<p><em>James Wilson shrugging, Joe holding Sis back<\/em><\/p>\n<p style=\"text-align: center\"><em>WILSON<\/em><\/p>\n<p style=\"text-align: center\">Yes&#8230; on purpose&#8230; for good reason&#8230;<\/p>\n<p style=\"text-align: center\">And that&#8217;s\u00a0<strong>no<\/strong> reason to use judicial power to get\u00a0<strong>around<\/strong> the people.<\/p>\n<p style=\"text-align: center\"><em>SIS (furious)<\/em><\/p>\n<p style=\"text-align: center\">How can you\u00a0<strong>say<\/strong> that?<\/p>\n<p style=\"text-align: center\">If\u00a0<strong>judges<\/strong> hadn&#8217;t created constitutional rules&#8230; if we&#8217;d had to <strong>wait<\/strong> for amendments&#8230;<\/p>\n<p style=\"text-align: center\">We&#8217;d still have\u00a0<strong>segregation!<\/strong> Discrimination might still be\u00a0<strong>legal!<\/strong> Abortion-<\/p>\n<p style=\"text-align: center\"><em>JOE<\/em><\/p>\n<p style=\"text-align: center\">Whoa &#8212; we&#8217;re getting\u00a0<strong>way<\/strong> ahead of ourselves! Save it for when we\u00a0<strong>get<\/strong> there!<\/p>\n<p style=\"text-align: center\">But you\u00a0<strong>do<\/strong> have a point&#8230;<\/p>\n<p><em>Joe watching a pendulum swing and BONK pawn-shaped markers off the ground.<\/em><\/p>\n<p style=\"text-align: center\"><em>JOE<\/em><\/p>\n<p style=\"text-align: center\">Yes, societal attitudes\u00a0<strong>do<\/strong> change. And yes, the law should adapt. Just use the ordinary meaning of the plain text at the time it was written.<\/p>\n<p style=\"text-align: center\"><em>JAMES MADISON<\/em><\/p>\n<p style=\"text-align: center\">And I say who\u00a0<strong>cares<\/strong> what\u00a0<strong>we<\/strong> were thinking! Just rely on what the\u00a0<strong>people<\/strong> thought it meant at the time\u00a0<em>they<\/em> adopted it.<\/p>\n<p><em>Sis, a judge, and a random person<\/em><\/p>\n<p style=\"text-align: center\"><em>SIS<\/em><\/p>\n<p style=\"text-align: center\">And I say who\u00a0<strong>cares<\/strong> what they were thinking! Just apply what it means to us\u00a0<strong>here<\/strong> and\u00a0<strong>now.<\/strong><\/p>\n<p style=\"text-align: center\"><em>JUDGE<\/em><\/p>\n<p style=\"text-align: center\">And I say who\u00a0<strong>cares<\/strong> what they were thinking! Just apply its essential\u00a0<strong>principles<\/strong> to modern situations.<\/p>\n<p style=\"text-align: center\"><em>PERSON<\/em><\/p>\n<p style=\"text-align: center\">And I say who\u00a0<strong>cares<\/strong> what they were thinking!
