In this defense, you&#8217;d need the jury to believe that a reasonable person\u2060\u2014not just the accused person\u2060\u2014would have been equally provoked.<\/p>\n<p><em>Average Joe talking head<\/em><\/p>\n<p style=\"text-align: center\"><em>AVERAGE JOE<\/em><\/p>\n<p style=\"text-align: center\">It&#8217;s an &#8220;objective test.&#8221;<\/p>\n<p>(When you&#8217;re concerned with what the accused was actually thinking, we say you&#8217;re being\u00a0<span style=\"text-decoration: underline\"><strong>subjective.<\/strong><\/span><\/p>\n<p>When you&#8217;re concerned instead with what some hypothetical\u00a0<strong>reasonable person<\/strong> would have thought in that situation, you&#8217;re being\u00a0<span style=\"text-decoration: underline\"><strong>objective.<\/strong><\/span>)<\/p>\n<p>Legal theorists have tried for generations to come up with a definition of &#8220;reasonable person&#8221; that juries could apply.
